Applicants must renew visas within 12 months and meet stricter conditions

In a significant shift, the US Department of State has reinstated pre-pandemic eligibility rules for the visa interview waiver program, commonly known as Dropbox.

Effective February 18, 2025, these changes impose stricter conditions on visa renewals, reducing the number of applicants eligible for interview waivers and increasing the likelihood of mandatory in-person interviews. For H-1B visa holders, this means adjusting expectations and preparing for additional hurdles in the renewal process.

Updated eligibility rules

The revised Dropbox criteria have substantially limited who qualifies for the interview waiver. The three key changes include:

  • Same visa classification: Applicants must renew a visa in the same nonimmigrant category as their previous one. For example, an individual renewing an H-1B visa must have held an H-1B visa before.
  • Shortened expiry window: The previous 48-month renewal period has been reduced to just 12 months. If a visa expired more than a year ago, the applicant must schedule an in-person interview.
  • Application location restrictions: Renewals must be processed in the applicant’s country of nationality or residence, eliminating flexibility for those who previously applied elsewhere.

These restrictions mean that many applicants who previously benefited from Dropbox renewals must now prepare for in-person interviews, significantly altering the visa renewal process.

Increased in-person interviews

For H-1B visa holders, the reduced eligibility window means that a greater number of individuals will be required to attend in-person interviews. This shift has already led to unexpected refusals and delays, even for applicants who assumed their Dropbox submissions would be processed without issue.

A recent example from the US embassy in Delhi illustrates the impact of these changes. An applicant who submitted documents through Dropbox was initially marked as "Application Received." However, shortly after, the status changed to "Refused," accompanied by a 221(g) letter, requiring the applicant to attend an in-person interview. This abrupt change caused significant disruptions, particularly as the applicant had a flight scheduled within days.

Understanding 221(g) letters

A 221(g) letter is issued when additional administrative processing or documentation is required. While it does not mean outright rejection, it temporarily places the visa application on hold until further steps are completed. This measure has become increasingly common under the new Dropbox rules, making prior preparation crucial.

Applicants receiving a 221(g) letter must provide the requested documents or attend the in-person interview as instructed by the consulate. The processing time for such cases varies, potentially leading to longer wait times for visa approvals.

The in-person interview experience

While the sudden requirement for in-person interviews has caused anxiety, many applicants report that the actual interview process remains straightforward. Questions typically focus on employment details, petition validity, and educational qualifications. In most cases, if the applicant has all necessary documents in order, visa approvals follow shortly after the interview.

However, the unpredictability of receiving a 221(g) letter or being required to attend an interview at the last minute makes advance preparation essential. Visa applicants should account for potential delays when planning travel and work commitments.

Recommendations for applicants

Given these significant changes, H-1B visa holders and other applicants must take proactive steps to avoid unnecessary complications:

  • Stay updated: Regularly check official US embassy and Department of State announcements for the latest visa policies.
  • Plan for delays: With an increased likelihood of interviews, applicants should build extra time into their schedules to accommodate possible delays in the visa renewal process.
  • Confirm eligibility: Before relying on Dropbox, verify that all eligibility requirements are met to avoid unexpected refusals.
  • Prepare for interviews: Even if initially eligible for Dropbox, be ready for an in-person interview by ensuring all necessary documents are readily available.

H-1B registration updates

In addition to the Dropbox changes, the US Citizenship and Immigration Services (USCIS) has implemented updates to the H-1B electronic registration process. The initial registration period for the Fiscal Year 2026 H-1B cap will run from March 7 to March 24, 2025. This electronic system streamlines the registration process, but recent rule changes aim to prevent fraud and increase fairness in selection.

Key statistics from the FY 2025 registration process highlight a decline in the number of duplicate applications. USCIS received 470,342 eligible registrations, a 38.6 percent decrease from FY 2024, indicating that the system is effectively reducing manipulation attempts. Additionally, 135,137 applicants were selected in the final lottery round, ensuring transparency and fairer distribution of H-1B visas.
