UAE expands abortion law: Here is what you need to know
Women can now terminate pregnancies in rape and incest cases
Dubai: In a significant move towards reproductive rights, the United Arab Emirates has also legalized abortion in cases of rape, incest, and request of the spouses. Previously, women were only allowed to terminate pregnancies if their life was in danger or if the fetus had a deformity.
The specific circumstances under which spouses can request an abortion have not yet been detailed. However, such requests will be subject to evaluation and approval by a designated committee.
With the new resolution and the prevailing Medical Liability Law, abortions can now be done in five cases.
-
Rape
-
Incest
-
Spousal request
-
Medical risk to the mother
-
Fetus deformity
The Ministry of Health and Prevention (MoHAP) had earlier revealed details about the committee that will be formed “within each health authority”. The committee comprises three members: Doctors specialized in obstetrics/gynecology and psychiatry; and a representative of the Public Prosecution.
Aligned with international standards
Legal experts believe this reform will have a profound impact on women's health and safety, especially by reducing the number of women resorting to dangerous illegal procedures. The resolution prioritizes the well-being of women by acknowledging the mental and physical strain of unwanted pregnancy.
The legislative reform aligns with international standards and reflects a broader effort to modernize the legal system and empower women.
Key provisions
The new law goes beyond simply expanding access to abortion. It also incorporates safeguards to ensure the safety and well-being of women seeking the procedure.
-
Mandatory counseling: Women must undergo medical and social counseling before and after the abortion to ensure they are making informed decisions and have the necessary support.
-
Medical safety: Abortions can only be performed by qualified obstetrician-gynecologists in licensed healthcare facilities, minimizing health risks.
-
Gestational limit: The procedure can only be performed within the first 120 days of pregnancy.
-
Residency requirement: Expatriates seeking abortions must have resided in the UAE legally for at least a year.
A step forward for women's rights
Empowering women with control over their bodies and reproductive health, the UAE's landmark reform on abortion signifies a move towards a more compassionate, women-centered healthcare system.
